Terms of Service

These Terms govern access to and use of the Beside application, website and associated services, together referred to as the “Service”.

“Beside”, “we”, “us” and “our” mean the operator providing the Service under the Beside name. “You” means the person using the Service.

Publishing a new version of these Terms does not, by itself, mean that existing users have accepted it.

You must not create an account or continue using account-based services if you do not accept the applicable Terms.

Any additional purchase conditions must be presented before you commit to the purchase. They apply to that purchase without removing rights you have under mandatory law.

You may use Beside only if:

• You are at least 18 years old.
• You have the legal capacity to enter into this agreement.
• Your use is permitted under the laws that apply to you.
• You use the Service for yourself, not to impersonate another person.
• You are not evading a restriction or ban imposed by Beside.

Provide accurate information where requested, particularly your age and account information. Your profile must not materially misrepresent who you are. Keep information reasonably up to date.

Accounts are personal. Do not sell, rent, transfer or share your account, or create accounts to manipulate the Service.

Beside provides tools for discovering and connecting with other users, including proximity-based discovery, profiles and interactions.

Discovery depends on factors such as compatible devices, permissions, settings, connectivity, operating-system restrictions and other users’ participation. Current technical requirements are described in the relevant App Store or Google Play listing and in the Service.

A recorded encounter is a technical indication of device proximity. It is not proof that two people met, saw one another, were in the same room or are currently in a particular place. Encounters may be incomplete, delayed or inaccurate.

Beside does not guarantee:

• That every nearby person or encounter will appear.
• The availability of particular users.
• A match, reply, meeting, relationship or other personal outcome.
• The accuracy of another user’s statements.
• Another user’s identity, intentions, conduct or safety.

Features may differ between devices or versions. Changes remain subject to Section 13 and any applicable consumer rights.

Beside is not an emergency service.

Take reasonable steps to protect your device, sign-in methods and account access. Do not disclose authentication credentials or allow others to use your account.

Contact us promptly if you suspect unauthorized access or misuse. We may take proportionate protective measures, including temporarily restricting access while a security concern is investigated.

You are responsible for actions you take or authorize through your account. These Terms do not automatically make you responsible for unauthorized activity outside your control or for failures attributable to Beside.

You are responsible for your internet access, device and any charges imposed by your network or other service providers.

Device permissions can be managed through your device settings. Refusing or withdrawing a permission may prevent the related feature from working. Withdrawing a permission does not itself delete information already processed.

You must use Beside lawfully and respect other people’s privacy, boundaries and rights, both within the Service and in interactions arising from it.

You must not:

• Harass, threaten, stalk, intimidate, discriminate against or abuse anyone.
• Continue unwanted contact or bypass another person’s decision to stop communicating.
• Use encounter information to monitor someone’s movements, identify their home or workplace, or interfere with their safety.
• Impersonate another person or use misleading photos, fabricated identities or deceptive profiles.
• Commit fraud, run scams, solicit account credentials or deceive people into sending money or valuables.
• Publish someone else’s private information without a lawful basis.
• Upload sexual exploitation material, content involving sexual abuse of minors, non-consensual intimate material, or content promoting violence or unlawful activity.
• Send unsolicited sexual content or use the Service for sexual exploitation or trafficking.
• Infringe intellectual-property, image, privacy or other rights.
• Send spam, operate unauthorized advertising campaigns, or use the Service primarily for commercial solicitation.
• Collect profiles, photos, messages or encounter information to build databases, train models, market to people or otherwise exploit their information without authorization.
• Use bots, scraping tools or automated accounts to manipulate or extract information from the Service.
• Access another person’s account or data without authorization, bypass access controls, introduce malicious software or disrupt the Service.
• Submit knowingly false reports, retaliatory complaints or fabricated evidence.

An unsuccessful or unproven report is not, by itself, a false report.

Nothing in this section prevents lawful reporting, seeking support, preserving relevant evidence or communicating with authorities.

“Your Content” means the photos, profile information, messages and other material you submit through the Service.

You retain ownership of Your Content. You must have the rights, permissions or other lawful authority necessary to submit it and allow the uses described here.

You grant Beside a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, technically adapt, transmit and display Your Content only as reasonably necessary to provide and operate the Service, including:

• Displaying your profile through the relevant discovery features.
• Delivering messages and other interactions you initiate.
• Resizing or formatting material for technical compatibility.
• Handling support requests, reports, security issues and legal obligations.

We may allow service providers acting for us to perform these activities to the extent necessary for their work.

This licence does not transfer ownership of Your Content. It does not authorize unrelated advertising use of your photos or publication of your private conversations.

The licence ends when the relevant content is removed from our systems, except to the extent limited continued processing is lawful and necessary—for example, for shared conversations, resolving reports, legal claims or technical recovery copies. Personal-data retention and deletion are explained in the Privacy Policy.

You should avoid sharing information that could expose you or another person to harm. Recipients may save or share material outside Beside, even where doing so breaches these Terms. That risk does not remove our own legal responsibilities.

The software, design, branding, website materials and other content supplied by Beside are owned by the operator or their licensors, except for user content and material identified as belonging to others.

While this agreement remains in effect, you may access and use the Service for its intended personal, non-commercial purposes, subject to these Terms.

You may not sell, sublicense, commercially exploit or reproduce the Service or its protected materials without permission. You may not imply that Beside endorses you or your activities.

Restrictions on copying, modification or reverse engineering do not apply where the relevant activity is permitted by mandatory law or by an applicable open-source licence.

Your access may be restricted or ended only as described in these Terms and applicable law.

You decide whether to interact with or meet another user. A profile, encounter, like, match or other indicator is not a recommendation or assurance of safety.

Exercise reasonable caution. Protect your financial and account information, respect consent, and consider meeting in a public place and telling someone you trust about your plans.

Beside is not a party to personal arrangements, transactions or relationships between users.

Report conduct that appears unsafe or violates these Terms. If someone is in immediate danger, contact the appropriate emergency services rather than relying on an in-app report.

Nothing in this section excludes a duty or liability that the law places on Beside.

You can report a user or content through the reporting controls available in the app or by contacting info@besideapp.com.

A useful report identifies:

• The account, content or incident concerned.
• Where and when it occurred, where relevant.
• Why you believe it is unlawful or violates these Terms.
• Relevant supporting information.

For an intellectual-property complaint, identify the protected work or right and explain your authority to report it.

Provide information honestly and limit personal information about others to what is relevant. Do not send unnecessary sensitive documents.

Beside may review relevant account information, content and reports to address safety, misuse, security, support or legal concerns, as explained in the Privacy Policy. Some protective or enforcement actions may be automated.

Depending on the circumstances, we may remove content, restrict a feature, suspend an account or terminate access. We will consider the seriousness of the issue, available evidence, potential harm and whether conduct is repeated.

Urgent action may be taken without advance warning where necessary for safety, security or legal compliance. Otherwise, we will provide notice and an opportunity to address a remediable issue where appropriate.

Where required by law, we will explain the decision and available ways to challenge it. Information may be withheld where disclosure would unlawfully reveal another person’s information, compromise security or interfere with a lawful investigation.

You may request review by contacting info@besideapp.com, identifying the decision and explaining why you believe it is incorrect. A contested automated restriction will be considered by a person.

Reporting does not guarantee a particular outcome or replace contacting authorities. It does not limit any complaint, appeal or judicial remedy available under applicable law.

Any optional financial contribution or purchase requires a separate action by you. Accepting these Terms does not authorize a payment or recurring charge.

The applicable price, currency, item or benefit, and any payment-specific conditions will be presented before confirmation. Unless expressly stated in the offer, a voluntary contribution supports Beside without purchasing preferential treatment, a particular result or a promised future feature.

Payments made through an app store or another payment service are also subject to the relevant provider’s payment terms. Refund requests may need to follow that provider’s process. This does not remove any refund or other remedy you are entitled to claim from Beside under applicable law.

Deleting an account is not itself a refund request. Neither account deletion nor enforcement action automatically removes any mandatory refund rights.

We will not impose a new paid arrangement without presenting the relevant conditions and obtaining any required agreement.

You can end the account agreement at any time by using the account-deletion option in the app’s account settings. Accounts cannot be deleted by email.

For technical help with signing in or using the in-app deletion option, contact info@besideapp.com.

Uninstalling the app, signing out, stopping discovery or withdrawing device permissions does not, by itself, delete your account.

Account deletion does not necessarily remove:

• Copies another person has saved outside Beside.
• Shared conversation content that remains in another participant’s account.
• Information lawfully retained for the purposes and periods described in the Privacy Policy.

Beside may suspend or end an account for material or repeated violations, ineligibility, significant security or safety risks, or where required by law. We will follow the safeguards in Section 9.

If we discontinue the Service, we will give reasonable advance notice where practicable and legally permitted, together with information about available account and content options. Any applicable rights concerning paid services remain unaffected.

Ending this agreement does not remove accrued legal rights or obligations. Provisions that reasonably need to continue—such as ownership, lawful retention, liability and dispute provisions—continue only to the extent relevant and permitted by law.

Our Privacy Policy explains what personal information is processed, why, who receives it, how long it is retained and how you can exercise your rights.

Accepting these Terms is not blanket consent to optional tracking, marketing or other processing that requires separate consent.

The Service may link to external websites, social profiles, app stores or other services. Those services have their own terms and privacy practices. A link does not necessarily mean Beside endorses its destination.

We are not responsible for matters controlled solely by an independent third party, but this does not exclude responsibility for our own decisions, integrations or disclosures.

Any applicable app-store licence or usage rules also apply to your installation and use of the app. These Terms do not override mandatory platform conditions or statutory rights.

We will provide the Service with the care and standards required by applicable law. We do not promise uninterrupted availability, freedom from every error or compatibility with every device.

Maintenance, updates, network problems and circumstances outside our reasonable control may affect availability.

We may change the Service for valid reasons, including:

• Addressing security risks or unlawful misuse.
• Complying with legal requirements.
• Maintaining compatibility with devices, operating systems or supporting services.
• Correcting faults or improving usability and accessibility.
• Making reasonable operational changes or discontinuing a service that can no longer reasonably be maintained.

Changes will be proportionate to their purpose and will not remove mandatory rights.

Where a change materially disadvantages you, we will provide the notice, explanation and options required by applicable law. These may include advance notice in a form you can retain, continued access without the change, termination or an appropriate refund.

Routine updates do not authorize undisclosed new charges.

We may update these Terms where necessary to reflect changes in law, the Service, security requirements, the operator or the contractual arrangements described here.

Changes must have an identifiable reason and must not retrospectively remove accrued rights or impose new obligations for past conduct.

We will explain material changes and provide reasonable advance notice through an appropriate channel, such as the app or email. A shorter notice period may be used where a legal requirement or urgent security concern makes this necessary.

We will request renewed acceptance where required by law or by the nature of the change. Silence alone will not be treated as express consent where express consent is required.

If you do not accept a material change, you may end the agreement. Any additional termination or refund rights provided by law remain available.

Nothing in these Terms limits rights that cannot lawfully be excluded, including applicable rights relating to the supply, conformity and security updates of digital services.

Depending on the circumstances and applicable law, you may be entitled to correction of a problem, a price reduction, termination, reimbursement or another remedy.

Where an EEA consumer has a statutory right to withdraw from a distance contract, the normal withdrawal period is 14 days from conclusion of that contract. You can exercise an applicable right by sending a clear withdrawal statement to our email or postal address. Identify the relevant account or transaction so we can process the request.

For example:

I withdraw from my contract for [service or purchase], concluded on [date]. My account or order reference is [reference]. Please confirm receipt.

This wording is optional. Any legally applicable extension of the withdrawal period remains available.

Creating an account or starting to use the Service does not, by itself, waive a statutory withdrawal right. An exception applies only where its legal requirements—including any required separate consent and acknowledgement—have been satisfied.

Any reimbursement due will be made within the applicable legal deadline and, unless otherwise lawfully agreed, using the original payment method without a reimbursement fee.

For a service complaint, contact info@besideapp.com, explain the issue and indicate the outcome you seek. We will respond without undue delay and within any mandatory deadline. We may request information reasonably necessary to investigate, without using that request to improperly delay your rights.

You do not have to contact us before exercising a right to complain to a regulator or seek another remedy where the law permits you to do so.

You are responsible for your own unlawful conduct, breaches of these Terms and content you submit without the necessary rights. Any claim against you remains subject to applicable law, including requirements concerning fault, causation and the amount of loss.

Beside is responsible for losses attributable to its conduct to the extent required by applicable law.

To the extent the law permits, Beside is not responsible for:

• Loss caused solely by an independent user or third party and not contributed to by a failure for which Beside is responsible.
• Loss arising solely from your device, network or unauthorized modifications.
• Loss that was not reasonably foreseeable when the agreement was made.
• Business losses arising from using a service supplied for personal, non-commercial purposes.

These limitations do not exclude or restrict liability for fraud, intentional misconduct, death or personal injury where it cannot lawfully be limited, or any other non-excludable liability.

They do not remove statutory consumer remedies, data-protection rights or compensation rights under applicable law.

Nothing in these Terms requires you to reimburse Beside for Beside’s own unlawful conduct or automatically pay all of its legal costs.

We may transfer this agreement as part of a genuine reorganization or transfer of the Service, but only in accordance with applicable law and without unlawfully reducing your contractual rights.

We will provide any required notice identifying the new operator. Where your consent is legally required, we will obtain it.

Any related transfer or further use of personal information must comply with data-protection law and the applicable privacy disclosures. This clause is not unrestricted permission to sell or repurpose personal information.

You may not transfer your personal account or agreement to someone else without our permission.

The law and courts applicable to this agreement are determined by the relevant legal rules. These Terms do not deprive consumers of mandatory protections or access to courts and other remedies available where they live.

They do not require compulsory private arbitration or waive collective remedies where such restrictions would be unlawful.

If a provision is unenforceable, it will not apply to the extent prohibited. The remaining provisions continue where legally possible and where doing so does not fundamentally change the agreement.

A delay in enforcing a provision does not permanently waive the right to enforce it.

Translations are intended to convey the same meaning. Any discrepancy must be resolved consistently with applicable law and consumer protections.
